SHORT TERM RENTAL

N.A.P.A Inc is a provider of short term furnished accommodations and serviced suites in Mississauga and Toronto. We are exempt from the Residential Tenancies Act, 2006, Ontario under PART I, Section 5(a):

5(a) living accommodation intended to be provided to the travelling or vacationing public or occupied for a seasonal or temporary period in a hotel, motel or motor hotel, resort, lodge, tourist camp, cottage or cabin establishment, inn, campground, trailer park, tourist home, bed and breakfast vacation establishment or vacation home;

MAILBOX & POSTAGE SERVICES

Please note that mailbox keys are given to you upon request and are subject to a CAN$25/ one-time charge to be deducted from the security deposit. The charge is only applicable to stays less then a period of less then four months. If the key is lost or misplaced lock replacements are subject to a $100/ replacement charge.

CREDIT CARD CHARGES

All credit card transactions towards rental payments or security deposits are subject to a 3% surcharge, unless or if advised.

KEY PICK-UP/DROP-OFF

If at any time our representatives is required to deliver or pick-up keys outside one of our properties a CDN $50.00 charge will apply. This amount will automatically be debited in your security deposit.

N.A.P.A TECHNICAL OR REPAIR SERVICE CALL

Service call of any kind at any time is subject to a $75.00 charge to be automatically deducted from the deposit. Repairs or any other special requirements are subject to an additional cost. The service call charge may be reduced or removed based on the judgment provided by the N.A.P.A representative. We (N.A.P.A Inc) reserves the right to enter the furnished apartment premises for maintenance purposes.

WIRE TRANSFERS

All wire transfers are subject to a $15 fee that is deducted from the security deposit if any payment is made to the company in form of wire transfer. This cross border fee is applicable by the local financial institution.

BILLING & CREDIT CARD BOOKINGS

Your authorization of the use of your credit card number will secure a guaranteed booking with North American Private Accommodations Inc and your agreement to abide by all of the company’s terms and conditions. Whether or not you have actually signed the appropriate draft, verbal authorization of the use of your credit card confirms your reservation with the company. By signing the credit card authorization form you agree to abide by all the terms and conditions of NAPA Inc.

If an e-mail or chain of e-mails clearly states an offer for entering into a deal with all of the material terms and the other side responds by e-mail accepting the terms or providing a confirmation with security deposit then a valid contract has been forced even though no signatures have been exchanged as most bookings are accepted via email communication.

LATE PAYMENT CHARGES

It is the responsibility of the guest to make rental payments or any other requested payments by the due date. If payment is delayed for any reason a CAN$75.00 late payment charge will automatically be deducted from the security deposit without notice. This also applies to Cheques/Drafts/Money Orders that will not be cleared by the Financial Institution. Please make any arrangements or adjustments that you may require to make your payments prior to the due date. There are no exceptions of any kind with this policy being violated in any manner at anytime.

FAILURE TO PAY RENT

If the guest is behind on the rent, the company(NAPA Inc) allows 48 hours to bring the rent up to date. NAPA Inc reserves the right to terminate term of stay with a 48 hour written notice if it fails to receive rent due from the guest. It is understood the guest would vacate the premises upon receipt of this notice. Failure to do so may result in eviction due to failure to pay rent.

LOST KEYS

Our apartment doors are steel-reinforced and have the best locks, providing you with excellent security. The keys are expensive to replace! Please, please don’t lose your keys. If you lose them, we are usually required to change the locks for your security and the cost will run into $250.00. Should you lose your keys, you will be charged to replace them.

FOREIGN CURRENCIES

We accept payments in all major currencies including US Dollars and Euro Dollars. Foreign Exchange is subject to a $25.00 service charge deductible from your security deposit. The rate quoted is from our local financial institution and subject to change at any time without prior notice.

OVATION REGISTRATION FEE

All residents staying at the Ovation Residences in Mississauga are subject to a $40.00/per person surcharge for registration at the building regardless of the duration of the stay. This is a mandatory fee required by the building management and is applicable to each suite booking.

COMPLIANCE WITH CONDOMINIUM RULES BY ALL NAPA GUESTS AT ALL TIMES WITH NO EXCEPTIONS

Where applicable, in accordance with condominium rules, NAPA acknowledges the requirement to deliver an agreement which shall be signed by you, the tenant, to the following effect:
” I acknowledge and agree that I, the members of my household, and my guests from time to time will, in using the unit rented and the common elements, comply with the Condominium Act, the declaration, by-laws, and all rules and regulations of the condominium corporation, during the entire term of tenancy and will be subject to the same duties imposed by the above as if the tenant were a unit owner, except for the payment of common expenses, unless otherwise provided by the Condominium Act.”

US CHEQUES ACCEPTANCE POLICY

If you wish to make payments via US cheque, you would be liable to pay any bank fee including conversation rate differences. Security deposit will be held to cover any differences that may occur at anytime due to exchange rate fluctuations. N.A.P.A Inc reserves the right to debit your security deposit automatically to cover the due rental payment amounts. If required you would be needed to secure an additional deposit with N.A.P.A Inc in order to be permitted to pay via US cheques.

OVERNIGHT VISITOR PARKING

All requests for overnight visitor parking for your guests are to be requested 2 days prior and are approved subject to availability only. A rate of CAN$12.50/per day charge is automatically applied towards your deposit and monthly charges may vary from CAN$50.00 – CAN$150.00. We accept no responsibility towards any loss or damages that may occur to your vehicle during this time.

DEFERRAL FEE

Outstanding payments are to be received upon arrival. A deferral fee of $50.00 is charged if payment is not received without notice. No exceptions of any kind are accepted towards violation of this policy.

RIGHT OF ENTRY

We reserve the right to enter the Apartment at any reasonable time for reasonable cause. This includes the need to undertake unforeseen (internal and external) remedial repairs.
We will give you reasonable notice of such requirements and will do our best to restrict the hours of access from 9am-8pm wherever reasonably possible. In the event we are unable to reach you we reserve the right to enter the accommodation if necessary without notice.

PROTECTING YOUR PERSONAL INFORMATION

Protecting the privacy of our clientele is an obligation that we take very seriously. We are committed to protecting all of your personal information.

Electronic Delivery of Communications and Use of Electronic Signatures

Under this Consent, we may provide all Communications electronically by email, text message, or by making them accessible via our websites or applications. Communications include, but are not limited to, (1) agreements and policies required to use the Services, (2) payment authorizations and transaction receipts or confirmations, (3) account statements and history, (4) and all federal and provincial tax statements and documents. We may also use electronic signatures and obtain them from you.

  • We do not rent, sell or distribute any part of your information collected to any third party organization.
  • All credit card information is kept confidential and safeguarded by our secure server.

EQUIPMENT BREAKDOWNS

  • Please alert us of any problem as soon as it is identified and every effort will be used to rectify the problem as quickly as possible. If we are not informed of a problem we cannot resolve it for you.
  • While we cannot be held responsible for breakdowns of mechanical equipment in common area of the building or failure of public utilities, we will do our absolute best to resolve the problem in every way possible.

ARRIVAL & DEPARTURE DETAILS

On the date of arrival check-in is no earlier than 3:00PM unless otherwise discussed (in writing) and on the date of departure the check-out time must be no later than 11:00AM unless otherwise discussed (in writing).

SUITE OCCUPANCY: MAXIMUM NUMBER OF OCCUPANTS

NAPA Inc and its affiliated brands reserve the right to regulate the maximum number of occupants permitted to reside within each size dwelling unit, as follows as per :

  • For 1 Bedroom units: Maximum of 2 Occupants
  • For 1 Bedroom plus Den units: Maximum of 3 Occupants
  • For 2 Bedroom units: Maximum of 4 Occupants
  • For 2 Bedroom plus Den units: Maximum of 5 Occupants

NAPA would not allow occupants in addition to the above maximums without a fee if to be agreed to with guest prior to arrival only .

Violation of this condition without prior written agreement from NAPA will result in extra charge of CAD$10.00 per person, per night

Children under the age of 5 and occasional overnight guests are not subject to the above maximums or fees.

EARLY CHECK-OUT

A minimum of 30 days notice prior to the checkout is required to vacate the accommodation early and this policy is applicable to all stays. The termination of the rental has to fall on the 1st or 15th of the month that follows the 30-day period notice provided in writing. No credits or refunds applicable if stated on rental agreement. No refunds or credits will be issued if an early check-out is requested without a 30 day notice. Any exceptions made to any of the policies are subject to Company approval only.
Only if the company allows the guest to vacate the premises early at anytime based on request of the guest that is approved by the company, the rent for (7 days) will be deducted from the remaining rental days, to complete the standard cleaning, inspection, and releasing processes. The 7 day rental is automatically deducted from the remaining days balance refund (security deposit) anytime an early departure is accommodated.

CHANGES AFTER CONFIRMATION OF BOOKING

Any changes to your reservations after they have been confirmed by North American Private Accommodations Inc. will be subject to an administration charge of $200.00 if informed 21 days prior to arrival. The acceptance of changes in check-in and arrival dates remains at the sole discretion of NAPA Inc. and may be viewed as a cancellation subject to availability.

CANCELLATION POLICY

All reservation changes & cancellations are subject to prior approval. A $150.00 administration fee is charged towards any cancellations at any time. Additional fee upto the full month’s rent may be constituted based upon season and notice period provided by the client. A minimum of 45 days notice before arrival is required if a reservation is requested for cancellation. If reservation confirmations are cancelled before 45 days of arrival, the security deposit is non-refundable and full rental as per the invoice is payable unless otherwise settled between the two parties.

BOOKING CANCELLATION

N.A.P.A Inc reserves the right to cancel a booking by providing a two week notice, and a full refund of the deposit including any transfer charges.

REGISTRATION PACKAGE

A $75 charge is applicable if a registration package is provided to a client staying less than 14 nights at any time.

PETS POLICY: NO PETS POLICY AS PER CONDOMINIUM LAWS

At N.A.P.A Inc., we do not accept pets for a stay less than a period of three months. Pets are only accepted on stays for more than a 3-month period. At all times, it is the guest’s responsibility to provide details regarding their pet and have that accepted and approved by the property management before confirming their booking. If they are unable to do so, simply provide us with your pet details and we would get you the required information. In no manner is NAPA Inc. is responsible for the acceptance or approval from the property management for any specific type or kind of pet.

What’s Included In Your Rental

Rental paid covers the cost of the apartment including utilities, telephone service, basic cable television, high-speed internet and one underground parking. The only additional charges are for long-distance telephone calling, pay per view cable and any extra services you may request. The clients are responsible for any internet over-usage charges applied by Rogers above the allocated 80GB provided in all furnished apartments as per the Rogers Express Internet high speed plan.

GENERAL RULES

Extensions are subject to availability, and must be for a minimum of a 7-14 day period. Relocation of property or suite may be required.

  • We reserve the right to substitute accommodation in the best interest of our clients.
  • Telephone long distance charges must be secured by credit card guarantee or by a deposit of half of one month’s accommodation rental. Long distance charges will be subject to a nominal monthly plan rate or 30% surcharge (can be avoided if guest uses a personal calling card).
  • Pay-per-View or any other additional payable services are subject to a flat fee or 30% surcharge from N.A.P.A Inc.
  • If unit is given up before contracted period any refunds are subject to our re-renting the suite to another client – less a 10% fee.
  • Additional parking – must be requested and reserved at time of booking.
  • Keys, parking devices, cards etc. must be returned prior to leaving. A charge will be applied for any missing devices.
  • We will not be responsible for towing charges resulting from using incorrect parking stalls.
  • Suite layouts and prices may vary and subject to change without notice.

DISCLAIMERS AND LIMITATIONS ON LIABILITY

This web site and all materials contained on it are distributed and transmitted “as is” without warranties of any kind, either express or implied, including, without limitation, warranties of title or implied warranties of merchantability, non-infringement or fitness for a particular purpose and those arising by statute or otherwise in law or form a course of dealing or usage of service.

North American Private Accommodations Inc. Shall not be liable for any special, indirect, incidental, punitive or consequential damages that may result during the stay or from the use of, or the inability to use the material, whether the material is provided or otherwise supplied by north american private accommodations inc. Or anyone else, or even when n.a.p.a inc, the affiliates or an authorized representative thereof has been advised of the possibility of such damages. Notwithstanding the foregoing, in no event shall North American Private Accommodations Inc. Or the affiliates’ total liability to you for all damages, losses, causes of action (whether in contract or tort (including, but not limited to, negligence) or otherwise) exceed $100.

Disclaim any and all responsibility and liability for the accuracy, content, products, services or availability of information found on this site and on other web sites that link to or from this site from third parties not associated with N.A.P.A Inc. North American Private Accommodations Inc. And the affiliates make no representations or warranties as to the security of any information, including, without limitation, information that you might be requested to give any third party web site.

We will not transfer personal information to third parties, except for our business partners who have agreed to comply with legally required privacy standards and who will use the information only for the purposes disclosed at the time of collection.

Recognizing that your privacy is important, North American Private Accommodations employs technical measures to protect your personal information. However, no transmission over the Internet can be guaranteed to be completely secure at all times.

Any information that you provide to North American Private Accommodations (N.A.P.A) is transferred to us through a secure server. Your security is important to us and we implement advanced security measures to help it stay secured.

ACCURACY, ACCESS & RETENTION OF YOUR PERSONAL INFORMATION
North American Private Accommodations (N.A.P.A) will maintain as accurate a file as possible and will update your personal information as you provide it to us. We will keep your personal information for as long as it remains necessary for the identified purposes or as required by law, which may extend beyond the termination of our relationship with you. If you believe that we have inaccurate information on file, you may request that we update our records. Likewise, you may request that we destroy any outdated information.
